1. Agreement to Terms

By accessing or using FastBook ("the Service"), available at fastbookapp.com, you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Service.

These terms apply to all users, including business owners ("Tenants") who manage booking pages and their customers ("End Users") who make appointments.

2. Description of Service

FastBook is a multi-tenant online booking platform that allows businesses to:

  • Create and manage a public booking page.
  • Accept online appointments from customers without requiring account creation.
  • Send automated notifications via Email, SMS, and WhatsApp.
  • Manage staff schedules, services, and availability.
  • Process payments and generate invoices.
  • Access analytics, CRM, and marketing tools.

3. Account Registration

To use FastBook as a business owner, you must:

  • Provide accurate and complete registration information.
  • Maintain the security of your login credentials.
  • Be at least 18 years of age or the legal age of majority in your jurisdiction.
  • Accept responsibility for all activity under your account.

You must notify us immediately of any unauthorized access to your account.

4. Subscription & Payments

  • FastBook offers paid subscription plans (Starter, Pro, Max) billed monthly.
  • All payments are processed securely through Stripe.
  • Prices are listed in USD and are subject to change with 30 days' notice.
  • Subscriptions auto-renew unless cancelled before the next billing cycle.
  • No refunds are provided for partial months or unused features.
  • We reserve the right to suspend access for overdue payments.

Free Trial & Cancellation

You may cancel your subscription at any time by contacting us. Upon cancellation, your account will remain active until the end of the current billing period. After that, your booking page will be deactivated but your data will be retained for 90 days in case you wish to reactivate.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to gain unauthorized access to other users' accounts or data.
  • Upload malicious code, viruses, or harmful content.
  • Send spam or unsolicited bulk messages through our notification systems.
  • Abuse WhatsApp, SMS, or email messaging features to contact people who have not booked with you.
  • Impersonate another person or business.
  • Scrape, crawl, or use automated tools to extract data from the platform.
  • Interfere with the proper functioning of the Service.

Violation of these terms may result in immediate account suspension or termination.

6. Booking & Appointment Terms

For Business Owners:

  • You are responsible for setting accurate service details, pricing, and availability.
  • You are responsible for honouring confirmed appointments.
  • Cancellation policies are set by you and must be clearly communicated to customers.

For Customers:

  • Provide accurate contact information when booking.
  • Cancel or reschedule appointments in a timely manner using the links provided.
  • The business's cancellation and no-show policies apply to your booking.

FastBook acts as a platform facilitator. We are not a party to the service agreement between the business and the customer.

7. Payments & Fees

  • Payments between businesses and customers are processed via Stripe.
  • Businesses are responsible for configuring payment settings (full payment, deposit, or pay-later).
  • Standard Stripe processing fees apply and are the responsibility of the business owner.
  • Refund and dispute policies are determined by each business and must comply with applicable laws.
  • FastBook is not liable for payment disputes between businesses and their customers.

8. Intellectual Property

  • The FastBook platform, including its design, code, logos, and documentation, is owned by FastBook and protected by intellectual property laws.
  • You retain ownership of the content you upload (logos, descriptions, images).
  • By uploading content, you grant us a limited licence to display it on your booking page.
  • You may not copy, modify, or redistribute any part of the FastBook platform.

9. Data & Privacy

Your use of FastBook is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of data as described therein.

Business owners are responsible for complying with applicable data protection laws (including GDPR where applicable) regarding the customer data they collect through FastBook.

10. Service Availability & Uptime

  • We strive to maintain high availability but do not guarantee 100% uptime.
  • Scheduled maintenance will be communicated in advance when possible.
  • We are not liable for loss of revenue or bookings due to service downtime.
  • Third-party service outages (Stripe, Twilio, Meta) are outside our control.

11. Limitation of Liability

To the maximum extent permitted by law:

  • FastBook is provided "as is" without warranties of any kind, express or implied.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability is limited to the amount you paid for the Service in the 12 months preceding the claim.
  • We are not responsible for the actions, services, or quality of work provided by businesses using FastBook.

12. Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate accounts that violate these terms.
  • Upon termination, your booking page will be deactivated.
  • Data export is available upon request for 90 days after termination.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered business owners at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the revised terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FastBook operates, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.
